UNCONSTITUTIONAL RESTRAINT


PERPETRATORS OF ABUSE

Prop 63 co-authors Assemblyman Darrell Steinberg (D-Sac) and Sherman “Rusty” Selix, Jr., count on compassionate Californians to vote for millionaires to bankroll mental health industry boondoggles. The measure allows a long-abusive system to escape constitutionally mandated oversight by the state’s Office of Administrative Law while bypassing the state’s representative budget process. .

WHAT A “YES” VOTE BUYS

Here is but a sampling of the harm and abuse the U.S. Justice Department has unearthed in its investigation of conditions at Metropolitan State Hospital in Norwalk, California, one of the state’s four mental health facilities currently under federal review:

  • Metropolitan State Hospital infringed upon its patients’ First Amendment rights in not allowing them to communicate freely with government investigators.

  • Despite the hospital’s efforts to contain reports of its staff’s abuse and neglect, investigators recorded this one-year count at the adult psychiatric facility: 475 patient-against-patient assaults; 310 incidences of patients abusing themselves; 304 accidental injuries; and 42 allegations of patient abuse by staff. Patients required first aid on 749 occasions, more extensive medical treatment on 114 occasions and hospitalizations on 61 occasions.

  • At the youth psychiatric facility that houses approximately 100 children and adolescents, incidences of staff abuse and neglect over a 13-month period included 27 allegations of staff abuse; six allegations of rape and 28 instances of inappropriate sexual contact between children and adolescents. Over a 10-month period: 131 patient-against-patient assaults; 169 incidences of patients abusing themselves; and 74 accidental injuries (see “Trapped in the System”).

  • The State of California and the County of Los Angeles have, additionally, been penalized $73.3 million for False Claims Act violations with respect to claims submitted to Medicaid. .

    Prop 63 co-author Selix has tried — and failed — on three separate occasions to push through the legislature an “educational plan” that would indoctrinate school kids into the routine of reporting their classmates’ non-conformity. So far, all have been defeated.
    Steinberg has repeatedly introduced legislation on behalf of psycho-pharma interests for mandatory mental health screening for children. The state legislators, quite rightly, rebuffed it. It is not hard to imagine the eventual police state.
